Our mission is to actively monitor and remedy human rights violations around the world, promoting justice and advocating the protection of fundamental freedoms. Through meticulous research and analysis, we produce comprehensive judicial reports that are invaluable resources for our partners, including lawyers, NGOs, civil society organizations and individuals engaged in the defense of human rights.

 

Our judicial reports are carefully designed to provide an accurate and objective assessment of the human rights situation in different regions. They are essential tools for our partners, enabling them to take advantage of legal mechanisms, awareness-raising campaigns and local initiatives to combat and remedy human rights violations.

 

The information contained in our reports comes from a wide range of credible and verified sources, guaranteeing the accuracy and reliability of our findings. We strive to present a holistic picture of the human rights landscape, covering a wide range of violations, including civil and political rights, economic and social rights, gender-based violence, discrimination, and more. By providing an objective and comprehensive verification of the situation, our reports enable our partners to take informed action and work towards creating a fairer, more rights-respecting world.

 

This clinical work is carried out within the framework of partnerships based on trust and confidentiality. For the time being, therefore, the names of partners and the nature of sponsored projects remain confidential. For the same reason, as more than half of the mandates entrusted to the clinic are confidential, you will find below only a selection of the cases handled.

Les conditions du travail carcéral en France: étude sur les formes contemporaines d'exploitation des travailleurs incarcérés

Avril 2024

L'étude du système carcéral français a permis de mettre en exergue les avancées portées par la législation française en matière de travail des personnes détenues grâce à la réforme de 2021 et du décret de 2022. Pour autant, la pratique montre que les travailleurs, qu’ils soient nationaux ou étrangers, ne sont pas toujours soumis aux mêmes règles. Il a alors été question de mettre l’accent sur la marginalisation des travailleurs sans-papiers, souvent les premières victimes d’un système carcéral encore discrétionnaire. Ces lacunes et discriminations, souvent liées à l’origine des détenus impact la précarisation des plus pauvres, et persiste au sein du travail en milieu carcéral.

La responsabilité des entreprises concernant les impacts des changements climatiques sur les droits de l'Homme en Afrique

Janvier 2024

Ce rapport met en exergue l’inadaptation du droit applicable aux entreprises face aux changements climatiques et aux impacts de ces derniers sur les droits de l’homme, en particulier sur le continent africain.

 

En effet, malgré l’adoption, par les États, d’obligations incombant aux entreprises et de la volonté de ces dernières de réguler leurs propres activités, de nombreuses lacunes persistent en matière de régulation des entreprises, notamment multinationales. Ainsi, ce rapport souligne la nécessité d’adapter le régime juridique applicable aux entreprises et ce, que ce soit par une action internationale afin de contraindre les entreprises à respecter les droits de l’homme et réduire leurs impacts sur les changements climatiques ; ou bien, par la remise en cause du modèle stato-centré du droit international.

Le rôle des espaces verts dans l’amélioration de la qualité de vie urbaine

Aix Global Justice a le plaisir de vous présenter son dernier rapport sur le rôle des espaces verts dans l'amélioration de la qualité de vie urbaine.

 

Adoptant une approche interdisciplinaire, ce rapport présente les différents avantages, tels que la promotion de l'activité physique, une amélioration de la santé mentale ainsi qu'une réduction de la pollution et des disparités socio-économiques, que présente l'aménagement d'espaces verts en milieu urbain. Il fait le lien entre ces espaces et la réalisation de droits fondamentaux, tels que le droit à la vie, à l'alimentation, à la santé et à un niveau de vie adéquat. Il met ces avantages en perspective avec les externalités négatives de tels projets, comme la gentrification verte. 

Le droit à la santé dans le milieu carcéral bolivien et l’impact du covid-19

La Clinique, Aix Global Justice - Clinique Doctorale de Droit International des Droits de l’Homme, a le plaisir de partager avec vous son rapport intitulé « Le droit à la santé dans le milieu carcéral bolivien et l’impact du covid-19 ».

À la suite de recherches menées par les membres de la Clinique, ce document expose la réalité de la pratique et les conséquences des défaillances de l’État bolivien durant la période du covid-19, en mettant l’accent sur le milieu pénitentiaire. Le présent rapport décrit la situation des prisonniers et analyse la compatibilité de leur état de santé et de l’accès aux soins médicaux par rapport au droit international des Droits de l’Homme.

Uncovering the Silence: Exploring Sexual Violence Against Men in the Context of the Russian War in Ukraine

This paper delves into the harrowing and often overlooked issue of conflict related sexual violence against men during the Russian war in Ukraine, shedding light on the complex dynamics surrounding this underreported phenomenon. While conflict related sexual violence remains a pervasive concern in conflict zones worldwide, the experiences of male survivors in Ukraine demand a distinct and nuanced examination. This study unravels the multifaceted challenges faced by male victims, including barriers to reporting, societal perceptions of masculinity, and the impact of conflict-related trauma.

The exiles of the 2011 sub-Saharan migration crisis: the forgotten people of the Choucha camp

2022-2023

 

The aim of this report, the fruit of two years' work, is to shed light on the legal and human situation of a group of 26 migrants in Tunisia today.

Initially living in insalubrious conditions in the Choucha refugee camp (in Tunisia, on the Libyan border) managed by the United Nations High Commissioner for Refugees, between 2011 and 2017, they were, when the camp closed, taken to the center of La Marsa (near Tunis) where they have been living ever since. In addition to particularly difficult living conditions at La Marsa in violation of international human rights law, the "Choucha exiles" have no status under Tunisian law due to the absence of Tunisian asylum legislation.

The report describes the migratory path of these migrants, mainly from sub-Saharan Africa, but also warns of the abandonment of national and international authorities, and Tunisia's failure to meet its international obligations.

This report denounces the worrying increase in hatred against the Catalan national minority, which is becoming more and more notorious in Spain as time goes by.

Anti-Catalan hatred or Catalanophobia has been a historical reality in Spain since the rise of Castilian hegemony in the 15th century, with cases recorded throughout modern history. 

Hate speech goes beyond political rhetoric, as the ideas disseminated in the mass and social media have real effects on people's lives. Since the Catalan referendum, there has been a worrying increase in ultranationalist violence against Catalan citizens in favor of self-determination, which often goes unreported and unpunished.
